Lowe's Job Rights

Were You Denied a Job at Lowe's Due to Your Criminal History?

Employers who use criminal background checks to deny employment may be violating civil rights laws, especially when these practices result in discrimination.

Outten & Golden has recovered over $20 million for individuals impacted by criminal history discrimination and driven changes that have opened job opportunities across the country.

Outten & Golden's Recent Criminal History Discrimination Cases:

• O&G successfully sued the U.S. Census Bureau over its background check process, resulting in a groundbreaking $15 million settlement that gave 450,000+ Black and Hispanic Americans the opportunity to work on future census campaigns.

• O&G and the NAACP are co-counsel in Mandala v. NTT, a proposed class action that challenges the tech company’s use of criminal records to deny jobs to qualified Black applicants. This tenacious fight continues today in federal court.

• O&G successfully sued the Southeastern Pennsylvania Transportation Authority (SEPTA), after a Philadelphia bus driver had his employment revoked due to drug-related convictions on his background check. We recovered $3.6 million for affected job applicants, and SEPTA agreed to stop denying employment because of convictions, unless required by law.

• O&G recovered $1.5 million for job applicants who were unfairly denied employment by one of the country’s largest sports and entertainment venues. Our work also led the employer to change the types of interview questions they ask, and to allow applicants to see and dispute their background check results, before denying them a job.
